These Terms & Conditions (‘Terms’) constitute a legally binding agreement between you (‘User’, ‘Customer’, ‘you’) and Krushivaibhav Agro Farmers Producer Company Limited, a Farmer Producer Company incorporated under the Companies Act, 2013, bearing CIN U01100MH2019PTC333495, having its registered address at Gat No. 740/21, Khedgaon, Tal. Dindori, District Nashik Maharashtra, India  – 422205, (‘Company’, ‘we’, ‘us’, ‘our’), operating the commercial website under the brand name ‘Krushiexim’ at krushiexim.com.

By accessing or using this website or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms.

Use of the Website:

    Payments must be made in full prior to dispatch. We accept payments via UPI, NEFT/RTGS bank transfer, major credit and debit cards, net banking, and other payment methods made available through our secure payment gateway.

Shipping and Delivery:

Limitation of Liability:

Cap on Liability: To the maximum extent permitted by applicable law, the total aggregate liability of Krushivaibhav Agro Farmers Producer Company Limited to any user or customer for any claim arising out of or in connection with these Terms, the use of this website, or any order placed, shall not exceed the total amount paid by such user for the specific order or transaction giving rise to the claim.

Exclusion of Indirect Losses: Krushiexim shall not be liable, under any circumstances, for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profit, loss of business, loss of revenue, loss of goodwill, loss of data, or any other economic loss, even if Krushiexim has been advised of the possibility of such damages.

Third-Party Logistics: Krushiexim shall not be liable for any delay, loss, damage, or destruction of goods caused by third-party logistics providers, freight forwarders, shipping companies, or international couriers engaged in the delivery of your order.

Customs and Regulatory Risk: Krushiexim shall not be responsible for perishable goods held, confiscated, delayed, or destroyed by customs or port authorities in the destination country. The buyer assumes full responsibility for compliance with applicable import regulations and phytosanitary requirements in their jurisdiction.

Website Availability: Krushiexim does not warrant that this website will be available uninterrupted, error-free, or free of viruses or other harmful components. Access to the website is provided on an ‘as is’ and ‘as available’ basis without warranties of any kind.

Force Majeure: Krushiexim shall not be liable for any failure to perform its obligations under these Terms where such failure results from circumstances beyond its reasonable control, including acts of God, natural disasters, pandemics, war, civil unrest, government restrictions, or disruption to transport or logistics networks.

Governing Law:

These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any dispute, claim, or controversy arising out of or in connection with these Terms, including any question regarding their existence, validity, breach, or termination, shall be subject to the exclusive jurisdiction of the courts at Nashik, Maharashtra, India.

 

By accessing or using this website, you irrevocably submit to the personal jurisdiction of the courts located in Nashik, Maharashtra, and waive any objection to the laying of venue of any such proceedings in Nashik.

 

Termination:

Termination by Krushiexim: Krushivaibhav Agro Farmers Producer Company Limited reserves the right, at its sole discretion, to suspend, restrict, or permanently terminate your access to this website or your registered account, without prior notice, if:

• you breach any provision of these Terms & Conditions;
• we receive evidence of fraudulent, abusive, or unlawful activity on your account;
• you provide false, inaccurate, or misleading information during registration or at any time thereafter;
• required by applicable law or order of a competent authority; or
• we decide to discontinue or materially alter the services offered on this website.

Effect of Termination: Upon termination of your account, your right to access and use the website shall immediately cease. Any pending orders confirmed before the date of termination shall be fulfilled or refunded in accordance with our Refund & Cancellation Policy. Termination shall not affect any rights or liabilities that have accrued prior to the termination date.

Termination by User: You may close your account at any time by contacting us at krushivaibhavac@gmail.com. Account closure does not affect obligations arising from orders already placed.

Intellectual Property:
